How Does Crossmint Protect Copyright?
In Paella Inc (dba “Crossmint”) respects the intellectual property rights of others and expects its users to do the same. We have implemented a notice and takedown procedure as part of our commitment to addressing copyright infringement, in compliance with the US Digital Millennium Copyright Act.
Notice and Takedown Procedure
If you believe that your copyright has been infringed on the Crossmint platform, please notify us by submitting a detailed claim to our designated agent. You can reach our agent through our contact page here.
Your notice should include the following information (please include everything below when you send us your notice through our contact page):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- 4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
- A statement and acknowledgement from your part that:
- The complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. You can use the following one (please add it to the notice):
"I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
- The information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. You can use the following one (please add it to the notice):
"The information in this notification is accurate and I swear, under penalty of perjury, that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
Please note that you may be liable for damages if you materially misrepresent that a product or content is infringing your copyrights.
What Happens After a Notice is Received?
Upon receiving a valid infringement notice, Crossmint will act expeditiously to remove or disable access to the allegedly infringing material. We will also notify the user who posted the material, providing them with an opportunity to submit a counter-notice.
Counter-Notice Procedure
If you believe that your material has been removed by mistake or misidentification, you may submit a counter-notice using our contact page or replying to the notice of takedown that you should have received. This notice should include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
“I declare, under penalty of perjury, that I believe in good faith that the material identified herein was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.” - Your contact information, including your address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if you are located outside the United States, for any judicial district in which Paella Inc (dba Crossmint) may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
Repeat Infringer Policy
Crossmint maintains a policy of terminating the accounts of repeat infringers of this copyright notice and applicable copyright regulations. Users found to repeatedly infringe copyright on the Crossmint platform will have their accounts terminated. This action is taken after a user receives more than two notices of infringing activity and/or has content removed for infringement reasons multiple times.
For inquiries or to appeal a decision to terminate, please reach out via our contact page. Note that you may be required to fix all the copyright violations that have led to the termination of your account prior to reinstatement.
